By using this website, you agree to the following Terms and Conditions.
SpeakEasy! Pronunciation at Conversation Café LLC – hereinafter known as the “website owner” of the SpeakEasy! PRO Academy – including subsidiaries and affiliates (“website” or “website owner” or “we” or “us” or “our”), and including but not limited to the URL and websites.
Thank you for using SpeakEasy! PRO Academy. These are the terms of use (Terms), which apply to your use of the (Site) and the services available to you on the Site (Services). For information on how information is gathered and used at the Site, please go to our privacy policy. The Privacy Policy is incorporated into these Terms by reference. If you do not agree to these Terms, you must discontinue using the Site and terminate your registration with us.
- Registration:
When you register with SpeakEasy! PRO Academy, you will be asked to provide us with personally identifiable information that we may request, all of which will become part of your profile, and which you can add to or change from time to time. You will also be asked to select a screen name and password, which will serve to identify you as a registered user each time you visit the Site and allow you to access your account. You may not (i) select or use a screen name of another person with the intent to impersonate that person, (ii) use a screen name in which another person has rights without authorization from that person, or (iii) use a screen name that SpeakEasy! PRO Academy, at its sole discretion, deems it offensive. You agree to provide (i) true, accurate, current, and complete information about yourself as prompted by the registration form, and (ii) maintain and properly update your profile to keep it true, accurate, current, and complete. If you provide information that is untrue, inaccurate, not current, or incomplete, or if you use SpeakEasy! PRO Academy has reasonable grounds to suspect that you have, we have the right to suspend or terminate your registration status and deny you future use of the Site and the Services (or any portion thereof).
You must be at least 14 years old to register and use the Services independently as a minor. You may use the site if you are under 14, provided you are doing so under the guidance of your school, parent, or guardian.
- Use of the Site:
This Site and the Services offered are intended for your personal, noncommercial use in accordance with these terms. Your account is for use by a single individual only and may not be shared. You agree that you will not (i) copy, display, or distribute any part of the Site, in any medium, for any commercial purposes, or (ii) alter or modify any part of the Site other than as may be reasonably necessary to use the Site for its intended purpose. You further agree that you will not use any automated devices, such as spiders, robots, or data mining techniques, to catalog, download, store, or otherwise reproduce, store, or distribute content available on the Site, or to manipulate the Site or the Services, or otherwise exceed the limited access granted to you by SpeakEasy! PRO Academy.
The trademarks, names, logos, and service marks (collectively “trade marks”) displayed on this website are registered and unregistered trademarks of the website owner. Nothing on this website should be construed as granting any license or right to use any trademark without the prior written permission of the website owner.
- Personal Profile:
By creating a profile and accessing content on the Site, information and your activity on the Site are not visible to everyone who visits the Site, registered users and visitors alike, unless you choose to make it visible. You can enable or disable the invisible mode at any time. However, enabling invisible mode will not affect information that had been previously posted. Any previously posted information may still be visible to other users. SpeakEasy! PRO Academy makes every effort to ensure that your profile and posts are displayed based on your privacy preference. However, mistakes can happen. If you believe that your profile or activities are being displayed in a manner that you did not authorize, you can notify us of the error by using the “Contact Us” button on any page of the Site, and we will correct the problem promptly. However, you agree that your sole remedy against us if we were to make such a mistake is to require us to change the privacy settings to those that you originally requested.
- User Submissions:
Some of the content on SpeakEasy! PRO Academy is submitted by our users. You acknowledge that by using the Site, you may be exposed to content that you find objectionable, indecent, or offensive, or which is inaccurate, misleading, or incomplete. We are not responsible for the accuracy, completeness, or usefulness of any content, nor do we endorse such content. We do not verify the identity of people using our Site. You use the Site and the content at your own risk.
By signing up for a trial class or creating an account with us, you consent to us gathering certain information about you to process your order. This may include (but is not exclusively limited to) information such as your full name and email address (so we can update your about your classes), your IP address (this securely collected by our payment system so that we can validate your payment information and prevent fraudulent orders), and the order will be added to your purchase history, which we also retain, to be able to help with inquiries and see which customers have ordered in the past.
For the purposes of placing your order, we use a secure third-party payment provider that will securely handle transaction information (our website is secure to the highest level of PCI Compliance via Stripe and PayPal, 2 of the world’s most secure, best-known, and most reliable payment systems). If you place a sign up for a trial lesson and create an account you will be opting into marketing communications, or, if you sign up to our email list via our website, we may use this information to process your order (if you’ve processed an order), to contact you about an order, or, to notify you about appropriate company information such as newsletter, sales, updates, news information, etc. You may opt out of these communications at any time, either by contacting us or by clicking the “unsubscribe” link in the email. We use a secure, third-party email provider to store and manage email subscription information.
You may request that we delete your customer information at any time by contacting us. We will carry out this request within 30 calendar days.
- Usage Policies:
All content that you post to SpeakEasy! PRO Academy, including videos and other content that you upload, must comply with these Terms. You take sole responsibility for all content that you post on the Site and the consequences of posting that content. You are responsible for obtaining all necessary rights to upload, post, and distribute the content. You agree that you will not upload, email, transmit, or otherwise make available any content that:
- – is threatening, defamatory, abusive, obscene, pornographic, or any material that would give rise to any civil or criminal liability under applicable law;
- – could infringe any copyright, trademark, publicity or privacy right or any other intellectual property right of any person or entity unless you have first received permission from the owner of those rights to use the materials;
- – contains slurs, hate speech, or attacks an individual or group based on race, color, religion, national origin, or sexual preferences;
- – constitutes spam;
- – is a solicitation or advertisement for any commercial product or activity;
- – constitutes behavior that does not support a safe and comfortable environment for all users; or
- – contains any materials that encourage inappropriate or unlawful conduct.
We may, at our sole discretion, immediately terminate your access to the Site should your conduct fail to conform with these Terms.
You understand that you are personally responsible for your behavior while on the Site and agree to indemnify and hold SpeakEasy! PRO Academy, and its affiliates, business partners, and their respective officers, directors, employees, and agents, harmless from and against any loss, damage, liability, cost, or expense of any kind (including attorneys’ fees) that we may incur in connection with a third party claim or otherwise, in relation to your use of the Services or access to or use of the Site, or your violation of either these Terms, applicable law, or the rights of any third party.
We have the right to view and monitor any content posted to this Site, and we reserve the right, but not the obligation, to monitor, edit, or remove any content at any time and without notice if we believe that the content violates these Terms, removal is necessary to protect the rights, property, or personal safety of SpeakEasy! PRO Academy, its users, and the public, if required to do so by law, or if we believe in our sole discretion that doing so will improve our Site and the experience of our users.

- Use of Your Information:
By using the service, recording your voice, and submitting content to the Site, you grant SpeakEasy! PRO Academy, and its successors in business, a perpetual, worldwide, royalty-free, and non-exclusive license to reproduce, distribute, modify, edit, display, adapt, create derivative works from your recordings or the content, for any commercial purposes, and in any medium now existing or hereinafter developed, without your prior approval or the payment of any compensation.
- External Links:
External links may be provided for your convenience, but they are beyond the control of the website owner, and no representation is made as to their content. Use or reliance on any external links and the content thereon provided is at your own risk. When visiting external links, you must refer to that external website’s terms and conditions of use. No hyperlink shall be created from any website controlled by you or otherwise to this website without the express prior written permission of the website owner. - Public Forums and User Submissions:

PRO Academy owns a copyright in the selection, coordination, arrangement, and enhancement of such content and a copyright in the Site. All trademarks appearing on this Site (“Marks”) are trademarks of their respective owners, including SpeakEasy! PRO Academy and its partners. Users are prohibited from using any Marks without the written permission of SpeakEasy! PRO Academy or any third party that may own the Marks.
All content on the Site is provided AS IS for your information and personal use only. You may not copy, publish, transmit, distribute, perform, sell, create derivative works of, or in any way exploit, any of the content, in whole or in part, without SpeakEasy! PRO Academyl’s prior written consent. - Emails & Messaging from Us:
By registering for SpeakEasy! PRO Academy, you will receive online communications from SpeakEasy! PRO Academy. To unsubscribe from any SpeakEasy! PRO Academy email list, click on the “Unsubscribe” link at the bottom of the email or visit the settings after logging in.
- Arbitration:
Arbitration Notice: When you agree to these terms, you are agreeing (with limited exception) to resolve any dispute between you and SpeakEasy! PRO through binding, individual arbitration rather than in court. Please review carefully the “dispute resolution” section below for details regarding arbitration.
- Disclaimer of Warranties:
You understand that your use of the site and services (including any downloads or any loss of data or other damage to your computer system you experience from using the site and services) is at your sole risk. You understand that the site and services and all information, products, and content included in or accessible from the site or services. are provided on an “as is”, “where-is”, and “where available” basis, and are subject to change at any time without notice to you. You acknowledge that SpeakEasy! PRO makes no warranty that the site or services will be uninterrupted, timely, secure, or error-free. You understand that SpeakEasy! PRO does not warrant that the results obtained from your use of the site or services will meet your use of the site or services will meet your expectations. No warranty of any kind, whether oral or written, can modify the terms of the disclaimer outlined in this document.
Your use and browsing of the site is at your own risk. If you are dissatisfied with any of the materials contained in the site or services, or with any of these terms, your sole and exclusive remedy is to discontinue accessing and using the site and services.

- Liability Limitation:

PRO or its affiliates be liable to you (or any third party making claims through you) for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data, or other intangibles, or the cost of procurement of substitute goods or services, unauthorized access to and tampering with your personal information or transmissions, arising out of or related to the use, inability to use, unauthorized use, performance, or non-performance of the site or the services, even if SpeakEasy! PRO has been advised previously of the possibility of such damages and whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise.
Unless limited or modified by applicable law, the foregoing disclaimers, waivers, and limitations shall apply to the maximum extent permitted, even if any remedy fails its essential purpose. SpeakEasy! PRO’s licensors and contractors are intended third-party beneficiaries of these disclaimers.
If any part of these warranty disclaimers or limitations of liability is found to be invalid or unenforceable for any reason, then SPEAKEASY! PRO’S aggregate liability for all claims under such circumstances for liabilities shall not exceed fifty dollars ($50).
- Teacher Relationship to This Website:
All LIVE PRO Instructors listed on this website are independent contractors and may also provide services for other businesses. The website is not legally liable for the actions taken by the independent contractors. If you would like to report any inappropriate action taken by the independent contractors on this website, please contact us at admin@speakeasypro.net.
- Enrollment by Sponsorship of Discovery 7 with LIVE PRO Instructors:
These policies apply to the sponsored consultations for one-on-one instructions in all Discovery 7 courses by SpeakEasy!’s LIVE PRO Instructors.
Consultations can be scheduled with 24-hour notice or more, per your LIVE PRO Instructor’s instructions.
Classes can be canceled with a 24-hour notice or more at no charge. If they are canceled with shorter notice, the consultation is non-refundable.
All Discovery 7 consultations are enrolled with SpeakEasy! PRO Academy expires automatically after 6 months from the date of purchase.
All Discovery 7 course enrollments expire after 1 year (365 days).
All Discovery 7 course subscriptions continue month to month until canceled.
Discovery 7 consultations are suggested to be scheduled by the learner, with their LIVE PRO Instructor, in 2-week intervals.
If a refund is requested, the consultations already taken will be billed at full price based on our highest hourly price, and the remaining will be refunded within 30 days.
- Enrollment by Subscriptions: On-Demand monthly subscription program.
16.1: Subscription billing is recurring every 28 days.
16.2: Subscription is cancellable at any time.
- LIVE Private Instructors: LIVE Private Instructors courses will be managed per their own policy and terms with SpeakEasy! PRO Academy enrolled Learner/Students. Policy and terms include pricing, scheduling, canceling, expiration, frequency, and refunds.
- Guaranteed Course Terms & Conditions: The guarantee applies to the Discovery 7 suite of native-language specific courses.
The guarantee is that if you do not reach the level of pronunciation proficiency as indicated, as evaluated by a 3rd party evaluator, then classes are free until you do reach that level.
The guarantee is contingent on the Learner/Student following the curriculum outlined in each course – along with any supplemental material deemed necessary by the LIVE PRO Instructor.
The guarantee is contingent on the classes being taken at the frequency outlined by each course. For example, the Discovery 7, the Learner/Student must take at least 1 hour of 1:1 instruction every 2 weeks, a minimum of 20 minutes per day, 5 out of 7 days, and 40 minutes per day willfully integrating strategies in real-life daily activities for the time it takes to complete the curriculum.
The course must be completed within the time indicated, or the guarantee is not valid. For example, the Discovery 7 course must be completed 6 months from the purchase date.
The Learner/Student must attend calls with their Learner/Student Advisor when requested to evaluate progress and make adjustments to the course where necessary.
The Learner/Student can take no more than a total of 2 weeks off from the lessons during the course. This is to ensure that progress is not lost during that time. These courses are 100% online, so even if you are traveling, you can still take the classes at a time that fits your schedule.
Guaranteed courses can not be transferred to other Learners/Students once the course has been started.
The Learner/Student can take no more than one day off at a time, not in a sequence of two. The learner can take more than 2 weeks off from the lessons during the course. This is to ensure that progress is not lost during that time. These courses are 100% online, so even if you are traveling, you can still take the classes at a time that fits your schedule.
Guaranteed courses cannot be transferred to other Learners/Students once the course has been started.
Any violations of the terms of use of SpeakEasy! PRO Academy will voice the guarantee. This includes, but is not limited to: Being consistently rude and/or disrespectful to the LIVE PRO Instructor. Using lesson times for things other than learning English pronunciation. Booking and missing more than 2 consultations in a row.
- Termination:
We can suspend or terminate you as a registered user and your access to the Site or the Services, in whole or in part, at any time, immediately, and without notice if, at SpeakEasy! PRO Academy’s sole discretion, you fail to comply with any of the Terms.
- General Class Policies:
20.1: Rescheduling or Cancellation of Consultation/ Class with LIVE PRO Instructors
Consultation/ Class may be rescheduled or canceled by writing an Email to admin@speakeasypro.net or their LIVE PRO Instructor no later than 24 hours before the original Consultation/Class reservation. A Consultation/ Class reservation is considered to be any communication in which the LIVE PRO Instructor confirms the class. This can be via email or scheduling on the SpeakEasy! PRO Academy calendar. Any cancellation more than 24 hours before the class will result in the full class credit being paid and will not be re-credited. If no rescheduling has been done and a learner fails to attend the class, then that will be deemed as though they have attended, and they will be charged for that class.
20.2: Class Attendance
The Pro Instructor will wait for 15 minutes from the start of the time of the Consultation/ Class, and if, after 15 minutes, the learner does not connect to the Big Blue Button and start the Consultation/ Class, then the Pro Instructor will treat that Consultation/ Class as having been taken, and no refund will be given for nonattendance.
20.3: Cancellation by the PRO Instructor
Occasionally, the PRO Instructor may have an unavoidable emergency or illness that could result in them having no option other than to cancel your Consultation/Class for that day or week. When this happens, you will be sent an Email as soon as the LIVE PRO Instructor knows. You, as the learner, will not be charged the class credit for the canceled Consultation/ Class, and you are free to re-book your class or classes at a time when the LIVE PRO Instructor advises you that they can recommence work.
20.4: Consultation/Class Scheduling
Consultation/Class is scheduled by contacting your PRO Instructor directly or, if necessary, the class coordinator admin@speakeasypro.net. All Consultation/Classes must be scheduled at least 24 hours in advance.
20.5: Academic Consultation/Class Hour
Each Consultation/Class that is listed as one one-hour class will be allocated a class of 60 minutes. Therefore, all the one-hour consultations/classes will each have a duration of 60 minutes unless otherwise stated.
20.6: Consultation/Class Recordings
Classes may be recorded for Learners/Students to review and for quality control. These recordings will only be shared with the Learners/Students who take part in the Consultation/Class and LIVE PRO Instructors/staff. If SpeakEasy! PRO Academy would like to share the recordings publicly; we will get signed permission from all participants before doing so.
20.7: Consultation/Class Conduct
All Learners/Students and PRO Instructors are expected to behave respectfully, courteously, and in accordance with SpeakEasy! PRO Academy harassment and privacy policies while attending any Consultation/Class, including, but not limited to, privately instructed Consultation/Classes, group Consultation/Classes, webinars, or challenges.
20.8: Self Recordings
All Learners/Students and LIVE PRO Instructors are expected to have webcams on their devices turned on for the duration of each Consultation/Class.
20.9: Dress
All consultations/class attendees, including Learners/Students and instructors, are required to dress appropriately for each Consultation/Class, regardless of using a functional webcam or not. Attire will be considered acceptable, in general, if the clothing would also be considered acceptable in a public restaurant or cafè. Tops, but not limited to, shirts (t-shirt, collared shirt, button up), blouses, jackets, sweaters, and bottoms, including, but not limited to, pants, jeans, shorts, skirts, and dresses, must be worn while attending any SpeakEasy! PRO Academy Consultation/Class or event.
Attending consultations/classes in bathrobes, towels, lingerie, shirtless, bottomless, or in any form of underwear/undergarment is not appropriate and subject to removal from the Consultation/Class. Repeat violations of the dress code may also result in a permanent ban without refund from SpeakEasy! PRO Academy consultations/classes and events.
21: 3rd Party Sign Ups
If you are signing up somebody else for the services offered on this website (i.e., a business signing up employees, a school signing up Learners/Students, etc), you agree that it is your responsibility to inform the person or persons you are signing up of the terms and conditions of this Website.
22: General
22.1: Entire Agreement
These website terms and conditions constitute the sole record of the agreement between you and the website owner in relation to your use of the website. Neither you nor the website owner shall be bound by any express, tacit, or implied representation, warranty, promise, or the like not recorded herein. Unless otherwise specifically stated, these website terms and conditions supersede and replace all prior commitments, undertakings, or representations and terms and conditions, whether written or oral, between you and the website owner in respect to your use of the website. The entire terms and conditions are updated regularly, and it is the customer’s own responsibility to keep themselves informed of the latest conditions that affect them and their Consultation/Class or assignments.
22.2: Alteration
The Website owner may at any time modify any relevant terms and conditions, policies, or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then-current version each time you visit the website.
22.3: Conflict
Where any conflict or contradictions appear between the provisions of these website terms and conditions and any other relevant terms and conditions, policies, or notices, the other relevant terms and conditions, policies, or notices which relate specifically to a particular section or module of the website shall prevail in respect of your use of the relevant section or module of the website.
22.4: Waiver
No indulgence or extension of time which either you or the website owner may grant to the other will constitute a waiver of or, whether by estoppels or otherwise, limit any of the existing or future rights of the grantor in terms hereof, save in the event or to the extent that the grantor has signed or written document expressly waiving or limiting such rights.
22.5: Cession
The website owner shall be entitled to cede, assign, or delegate all or any of its rights and obligations in terms of any relevant terms and conditions, policies, and notices to any third party.

All provisions of any relevant terms and conditions, policies, and notices are not notwithstanding the manner in which they have been grouped or linked grammatically, severable from each other. Any relevant terms and conditions, policies, and notices shall be governed by and construed in accordance with the laws of the United States without giving effect to any principles of conflict of law. You hereby consent to the exclusive jurisdiction of the courts of California, USA in respect of any disputes arising in connection with the website, or any relevant terms and conditions, policies and notices, or any matter related to or in connection therewith.

22.9: SMS Disclosure
Please note that, subject to end-user opt-in, SpeakEasy! Pronunciation at Conversation Cafè will periodically send SMS for confirmation, appointment, or transactional notifications. MSG volume may vary. Text HELP for more assistance. Text STOP to unsubscribe. Msg&Data Rates May Apply. Carriers are not liable for delayed or undelivered messages.

You agree that, except for injunctive relief sought by SpeakEasy! PRO Academy for any violation of SpeakEasy! PRO Academy’s proprietary or other rights, any disputes relating to these Terms, your use of the Site or the Services shall be resolved by arbitration in accordance with the then-current rules of the American Arbitration Association (the “AAA”) before an independent arbitrator designated by the AAA. The location of arbitration shall be San Francisco, USA.
